For the purposes of these Terms of Business (“Terms”), “us” or “we” refers to Yash Services Limited, and “you” refers to our valued customer. By engaging our services, you are indicating your agreement to the Terms set out below.
Estimate
The estimate provided reflects the expected cost of the works based on our initial discussions. In the event of unforeseen circumstances or unexpected issues, we may need to review the original price and provide you with a new estimate. You have the right to accept or decline the revised price.
Written Quotation
The written quotation, following the estimate, represents the final price for the discussed works, including labor, materials, additional costs, and tax. Any subsequent variations to the works may result in a new or revised written quotation. You have the right to accept or decline the new quotation. If you decline, all works will cease, and you must pay in full for completed works as per the original quotation.
Customer Obligations
(i) If you are responsible for providing measurements for materials or products, you will bear the cost of replacement if the measurements are incorrect.
(ii) If you provide materials or products, you will bear the cost of replacement if they are faulty or unsuitable.
(iii) You must inform us of any known or suspected hazards on or around the premises where the works are to be carried out.
(iv) You will grant us access to the premises and ensure necessary consents and permissions are obtained before commencing the works.
(v) You are responsible for the safe storage of any materials or equipment left at the premises during the works.
(vi) Unless included in the quotation, you are responsible for any necessary improvements or redecorating following the completion of the works.
Supplier Obligations
(i) We will undertake the works with care, skill, and diligence, complying with all applicable laws and regulations.
(ii) We will supply high-quality materials and products and take responsibility for replacing any faulty or substandard items.
(iii) We will take good care of your property and remove any resulting waste material upon completion of the works.
(iv) We will provide one or more dedicated team members to carry out the works, at our discretion.
(v) We hold valid and current Public Liability Insurance and, where relevant, Employers Liability Insurance.
Materials and Products
All materials and products supplied during the works remain the property of Yash Services Limited until full payment is received. Title to such materials and products transfers to you only upon full payment.
Force Majeure
Neither party shall be held liable for any delay or failure in fulfilling their obligations under these Terms due to circumstances beyond their control.
Cancellation
In accordance with the Consumer Contract Regulations 2013, you have fourteen (14) days to cancel the contract after accepting our quotation. If services are provided during this cancellation period, you are obligated to pay for them.
Payments
Full payment terms are outlined in the applicable quotation. You agree to settle any undisputed invoices in full within 14 days of receipt.
